CALLING WITNESSES AND PRESENTING EVIDENCE
Since Plaintiff has the burden of proof, he will put on his case first. Some of the kinds of witnesses Plaintiff’s attorney will call are:
1. The Plaintiff to describe the accident and injuries.
2. The Defendant, to describe the accident and any matters contributing to it.
3. Investigating police officers.
4. Persons who witnessed the accident.
5. Persons who can testify as to Plaintiff’s condition before and after trial.
6. Medical doctors and other treating health-care professionals.
7. Economists (where awards are made for future damages, such as future medical expenses, the value of money paid now must be adjusted to its value for future payments.
8. Accident Reconstructionists (experts who testify as to the cause of the accident and as to how the accident happened).
After Plaintiff examines each witness, the defense has an opportunity to cross-examine each witness as they appear. After each cross-examination, the Plaintiff has the opportunity to examine the witness once more as to new matters raised in the cross-examination.

They will call many of the same kinds of witnesses as the Plaintiff. After Defendant examines each witness, the Plaintiff has an opportunity to cross-examine each witness as they appear. Throughout the trial of a personal injury case based on a traumatic brain injury exhibits will be introduced. Some kinds of exhibits are:
1. Photographs of the accident scene.
2. Photographs of injuries to the Plaintiff.
3. Photographs of (in the case of automobile accidents) the vehicles involved in the accident.
4. Videotapes of the accident scene
5. Medical bills.
6. Medical records.
7. Documentation regarding lost earnings.
8. Any other physical objects or documents helpful to the presentation of the evidence.
